In this case, we are asked to determine whether the ash generated by a municipal solid waste incinerator is “hazardous waste” that must be disposed of in accordance with the provisions of Subtitle C of the Resource Conservation and Recovery Act of 1976, 42 U.S.C. § 6901-6992k (“RCRA”). The incinerator in question— the Northwest Waste-to-Energy Facility— has been owned and operated by the City of Chicago (“the City”) since 1971.
