From the allegations in the complaint the accident must be deemed to have happened upon the high seas, for the vessel was on her homeward voyage from her port of destination in Alaska to her port of final discharge in Oregon. The theory of plaintiff is that defendant was the owner of the vessel pro hac vice for the voyage, and, therefore, being in possession and command, was responsible for the accident and liable in damages for the injury sustained.
