Robert Brooks sued Union Pacific Railroad Company (“Union Pacific”) under the Federal Employer’s Liability Act (FELA), 45 U.S.C. § 51 et seq., to recover damages for a back injury that he allegedly suffered while working as a machinist at Union Pacific’s locomotive repair shop in North Little Rock, Arkansas. Brooks alleged that his injury resulted from acute trauma to his back. Union Pacific moved for summary judgment.
