*490 ORDER GRANTING DEFENDANT’S MOTION FOR PARTIAL SUMMARY JUDGMENT

KENT, District Judge.

Pending before the Court is Defendant Arnica Mutual Insurance Company’s Motion for Partial Summary Judgment pursuant to Fed.R.Civ.P. 56(c). For the reasons stated below, the Motion is GRANTED.

I. Background

This is an action to recover under an automobile insurance policy for personal injuries sustained by the Plaintiff.
