BAZELON, Circuit Judge.

On January 22, 1947, the Commissioner of Immigration and Naturalization issued a warrant of arrest for deportation charging that appellant, a citizen of Uruguay, had remained in this country longer than permitted by law. Following appropriate administrative proceedings, appellant was ordered to leave the United States. He thereupon brought this action in the District Court, seeking a declaration that he is admissible to the United States for permanent residence and citizenship and is eligible for suspension of deportation.
