delivered the opinion of the court:

This is an appeal from a judgment of the county court of Montgomery county refusing to enter judgment against the lands and lots of the appellee railway company for failure to pay certain taxes of the village of Raymond, in said county.

It is conceded that on the hearing in the trial court the collector made a prima facie case for the people by the introduction of the delinquent tax list and proof of notice of application for judgment under the rulings of this court in People v.
