This is an appeal from the dismissal of a citizen enforcement action brought pursuant to the citizen suit provisions of the Clean Water Act (“CWA”), 33 U.S.C. § 1365, the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. § 6972, and the Comprehensive Environmental Response, Compensation and Liabihty Act (“CERCLA”), 42 U.S.C. § 9659, as amended by the Superfund Amendments and Reauthorization Act of 1986, Pub.L.
