This case, in tbe circuit court, was an action brought by tbe said Dawson against said Pogue and Nickell, to recover for merchandise alleged to have been sold to tbem, as co-partners, under tbe firm name of M. E. Pogue, by certain merchants doing business at tbe city of Portland, and tbe accounts therefor assigned to said Dawson.
