MEMORANDUM OPINION AND ORDER

RICHARD W. ROBERTS, District Judge.

Defendant has renewed its motion for summary judgment. Based on a review of the motion, plaintiffs opposition, and the entire record of this ease, the Court will grant the motion in part and deny it in part without prejudice.

I. BACKGROUND

In September 2006, plaintiff submitted a request to the United States Secret Service (“Secret Service”) under the Freedom of Information Act (“FOIA”), see 5 U.S.C. § 552, for the following information:
