At the January term, 1863, of this court, the People of the State on the relation of the Merchants’ Savings, Loan and Trust Company of Chicago, filed a petition against the auditor of public accounts of this State, for a mandamus, in which it is alleged, that the relators are a corporation organized and doing business under the laws of this State, and that they are the legal holders of certain State indebtedness of this State, other than the canal and school indebtedness, namely: refunded stock to the amount of one hundred and…
