MEMORANDUM OPINION AND ORDER INTRODUCTION

On April 11 and 12, 1983, the defendant, Sheldon Grant, was found guilty after a jury trial of assault in the third degree1 and *443possession or use of a dangerous weapon2 in the commission of a crime of violence.3 The case is now before the Court on defendant’s motion for judgment of acquittal or, in the alternative, for a new trial, pursuant to Rules 29 and 33 of the Federal Rules of Criminal Procedure, respectively.
