The Department of Public Works and Buildings, in accordance with the authority given by section 11 of the act providing for a State-wide system of hard roads, (Hurd’s Stat. 1921, p. 2846,) instituted proceedings in the county court of Marion county to acquire the right of way over certain land belonging to Anson A. Griffin and Emma J. Griffin for the purpose of building a hard road, being a part of route 2, as described in section 9 of that act.
