I. INTRODUCTION

Plaintiff Ronald Bert Smith is an Alabama death-row inmate, in the custody of the Alabama Department of Corrections (“ADOC”) awaiting his execution scheduled for December 8, 2016.1 On April 15, 2016, he filed a complaint under 42 U.S.C. § 1983 challenging the constitutionality of Alabama’s method-of-execution under the First, Eighth, and Fourteenth Amendments to the United States Constitution.
