This case involves the question as to which of two oil and gas leases is the superior lease.
On November 1, 1943, Mary A. Friend, owner of a 160-acre tract of land in Kingfisher county, executed and delivered to J. L. Shaw an oil and gas lease thereon for which the consideration of $160 was paid. This lease was not filed for record until November 10, 1943. In the meantime, and on November 5, 1943, Mrs. Friend executed and delivered to H. F. Elsey an oil and gas lease on the same land, the lease being taken in the name of T. A. Elsey, wife of H. F.
