This suit was brought by the appellants as creditors of Morris Crown and in behalf of all the other creditors, and alleged in substance that “ Crown, on December 3, 1880, being indebted to petitioners m various specified sums, executed a deed of assignment to Sharp E. Whitley for the benefit of his creditors, under the laws of Texas relative to assignments for the benefit of creditors.
