WILLIAMS, Circuit Judge.
After Chemetall GMBH acquired the assets of Morton International, Joseph T. Fraval left Morton and formed a competing company, Zr Energy, Inc. Chemetall sued Fraval for breach of his agreement with Morton to not use or disclose its confidential information. A jury found in favor of Chemetall. Fraval appeals the district court’s denial of Ms motion to dismiss Chemetall’s breach of contract claim, which the court treated as a motion for summary judgment, and challenges certain of the court’s evidentiary rulings and jury instructions.
