By the Court, Rhodes, J.

The parties entered into a contract in writing, bearing date December 30, 1858, whereby O’Connor agreed to build for Dingley a stone building of given dimensions, for which' Dingley was to pay him two thousand one hundred dollars; of which sum four hundred dollars was to be paid when the first story was completed ; four hundred dollars'when theo second story was completed; and five hundred dollars when the third story and gables were completed; and the agreement continues as follows: “And the balance, being eight hundred dollars, the party of the first part agrees to…
