1. INTRODUCTION
In this patent matter, Cordance Corporation (“Cordance”) alleges that Amazon.com, Inc. (“Amazon”) infringes U.S. Patent No. 6,757,710 (“the '710 patent”). Amazon counterclaimed for declaratory judgment that Cordance infringes its U.S. Patent No. 6,269,369 (“the '369 patent”). Cordance moved to dismiss the counterclaim, for lack of subject matter jurisdiction on the basis of no actual controversy.
