Plaintiff-appellant IPXL Holdings, L.L.C. (“IPXL”) appeals the judgment of the United States District Court for the Eastern District of Virginia granting summary judgment in favor of Defendant-appellee Amazon.com, Inc. (“Amazon”), see IPXL Holdings, L.L.C. v. Amazon.com, Inc., 333 F.Supp.2d 513 (E.D.Va.2004) (“Summary Judgment ”), and awarding Amazon attorney fees, see IPXL Holdings, L.L.C. v.
