Certified question from the Court of Civil Appeals for the Third Supreme Judicial District, as follows:

“This is a damage suit against a telegraph company. The trial'court overruled a general demurrer and special exceptions to the plaintiffs’ petition, and upon trial a verdict and judgment were rendered for the plaintiffs for $1235, and the defendant has appealed, and has assigned as error-the ruling of the trial court on the demurrers and other rulings, which assignments make it the duty of the Court of Civil Appeals to decide the following material question, which…
