WIDENER, Circuit Judge:

This is an appeal in a class action suit against the Commissioner of the Virginia Employment Commission (Commission) and the Secretary of the United States Department of Labor. The district court held that § 606 of the Federal Supplemental Compensation Act of 1982, 26 U.S.C. § 3304 note (1982) (the Act or 1982 Act) requires the Commission to consider requests for waiver of recoupment of overpayments made to beneficiaries under the Act.
