This is an appeal by appellant, Bruce Bable, from an order of the Ohio Department of Health (“ODH”), granting a certificate of need (“CON”) to 138 Mazal Health Care, Ltd. (“Mazal”), for a proposed project to establish a new one-hundred-bed nursing home in Perry Township, Salem, Ohio.
On October 11, 1994, Mazal filed a CON application with the director of ODH for the replacement and relocation of fifty long-term-care beds. The beds were the subject of a CON which was previously granted to Nentwick Convalescent Home (“Nentwick”) in 1992 for the treatment of Alzheimer’s/dementia…
