This action is before this Court upon an appeal from the final orders of the Circuit Court of Raleigh County, West Virginia, entered for various insurance companies with respect to the $360,750 insurance claim of the appellant, Kyle Wolford. The claim concerns the theft of mining equipment. Specifically, on August 11,1994, the circuit court granted the motion of the Landmark American Insurance Company and DVUA/WV, Inc., for summary judgment.
