Defendant-appellant Alberto Hernandez-Fundora appeals from a judgment of conviction entered September 13, 1993 in the United States District Court for the Northern District of New York, Thomas J. McAvoy, Chief Judge, that convicted Hernandez-Fun-dora, following a jury trial, of assault within the special maritime and territorial jurisdiction of the United States in violation of 18 U.S.C. §§ 113(c) and 7(3).
