Proceeding initiated in this Court pursuant to EDPL 207 to review a determination of the Board of Education of respondent Schuylerville Central School District which found that there was a public benefit to be served by the proposed condemnation of petitioners’ property.

Petitioners are the owners of an abandoned railroad bed approximately 50 feet wide and slightly over 2,000 feet long located in Saratoga County.
