SECTION “R” (3) ORDER AND REASONS Before the Court are defendants Shell Oil Company’s (“Shell”)1 and Evonik Corporation’s (“Evonik”)2 motions to dismiss plaintiffs’ complaint under Federal Rule of Civil Procedure 12(b)(6) for failure to state a claim.
