Lee v. YRM, Ltd.

—In an action to recover damages for fraud and breach of fiduciary duty, the plaintiffs appeal from an order of the Supreme Court, Dutchess County (Jiudice, J.), entered January 27, 1992, which granted the motion of the *283defendants Rand Manning Real Estate and Doris Manning for summary judgment dismissing the complaint insofar as it is asserted against them.

Ordered that the order is reversed, on the law, with costs, the motion is denied, and the complaint is reinstated.
