In an action to set. aside a purchase-money mortgage and to recover damages for misrepresentation, plaintiff appeals from two orders of the Supreme Court, Dutchess County (Jiudice, J.), both entered May 11, 1983, which, respectively, (1) granted defendant’s motion for summary judgment dismissing the complaint and (2) denied, as moot, plaintiff’s motion for leave to depose a nonparty witness.
