This case, in the main, appears to have been well tried. It is true that a nice criticism of each of the answers of the court to the points of the plaintiff’s counsel, and of each portion of the general charge assigned here for error, might, in several instances, seem to convict the learned judge of error. But when tested by all he said as a whole, hy collating its several parts, there are but two or three portions which can really be considered erroneous.
