delivered the opinion of the court.

Plaintiff, W. H. McGrahan, brought his action against the Public Indemnity Company, a corporation, in the superior court of Cook county to recover indemnity under a policy of insurance issued by the defendant. The defendant filed a demurrer to the declaration which was sustained. Plaintiff • elected to stand by his declaration and judgment was entered against the plaintiff for costs.
