HOLMAN, Commissioner.
At about 1:15 a. m. on September 19, 1954, Robert F. Davis was instantly killed when the automobile he was driving ran into one of the cars of defendant’s freight train at the railroad crossing maintained by defendant over Illinois State Highway No. 159 about a mile south of Edwardsville, Illinois. This action was instituted shortly thereafter by plaintiff as administratrix of the estate of her deceased husband seeking to recover the sum of $20,000 for his wrongful death. The case has been tried three times in the circuit court and this is the third appeal to this court.…
