—In a proceeding pursuant to CPLR article 78 to review a determination of the Commissioner of the New York State Division of Housing and Community Renewal dated August 27, 1992, which denied the *487petitioner’s application to increase rents, the appeal is from a judgment of the Supreme Court, Kings County (Krausman, J.), dated February 5, 1993, which, inter alia, granted the petition and vacated the determination.
Ordered that the judgment is reversed, on the law, with costs, the determination is confirmed, and the proceeding is dismissed.
