Defendant, Louis Or calles, was charged with the murder of Benny Padilla and with assaulting Nick Gundran with a deadly weapon with intent to commit murder. He pleaded not guilty and not guilty by reason of insanity. A jury found him guilty of murder of the first degree and imposed the death penalty. They failed to return a verdict on the count which charged the crime of assault and on motion of the People such count was dismissed.
