FRBAR, C.J.
This is an action on two promissory notes. The circuit court, jury waived, found for the plaintiff and íendered judgment for the full amount of both notes with interest and costs amounting in all to $539.87. The defendant brings this writ of error to set aside that judgment.
The three assignments of error that are relied on chiefly will be considered in their order.
