THIS MATTER comes before the Court on the Defendant’s Motion for Summary Judgment, filed December 14, 2009 (Doc. 55). The Court held a hearing on January 28, 2010. The primary issues are: (i) whether Plaintiff David Carroll’s can bring a claim for civil penalties under the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. §§ 1001 through 1461, for the misconduct he alleges; (ii) whether Carroll’s cause of action for negligent misrepresentation is ripe for adjudication; and (iii) whether Carroll has provided some…
