The plaintiff, Suda L. Franklin, in her complaint, alleges that the defendant is and was on the dates hereinafter mentioned a railroad corporation duly chartered and organized under the laws of the State of South Carolina, and as such it owned and now owns a certain railroad extending from the city of Atlanta, Georgia, through the State of South Carolina, in the county of Greenville, to the city of Charlotte, and that on the first of April, 1903, and for many years prior thereto, the said railroad as such was and is now being operated as a common carrier of passengers between said points.…
