*451In an action to recover damages for fraud and breach of contract, the defendant appeals from a judgment of the Supreme Court, Kings County (Rappaport, J.), dated September 18, 2003, which, after a nonjury trial, and upon a decision of the same court dated July 30, 2003, is in favor of the plaintiff and against him in the principal sum of $25,942.50.

Ordered that the judgment is reversed, on the law, without costs or disbursements, the cause of action alleging fraud is dismissed, and the matter is remitted to the Supreme Court, Kings County, to determine the amount of damages to be awarded for…
