Reversing.

Appellant owns a bouse and lot in tbe city of Pike-ville. Appellee owns an adjoining lot fronting on tbe same street. After appellee acquired bis lot in tbe year 1922, be made improvements on it. He constructed a retaining wall along tbe edge of a driveway separating tbe two lots and extended tbe retaining wall to include almost bis entire lot. He filled in a depression on bis lot with tbe eartb excavated from tbe basement of bis bouse, and bauled cinders placing them on bis lot so that tbe surface might be rendered level.
