STANLEY, Commissioner.
The appeal is f.rom a judgment upon a directed verdict for the defendant in an action for death of a fifteen year old boy, James Lynn Jones, caused by contact with a high voltage wire of the Kentucky Utilities Company. The trial court ruled the defendant was not primarily negligent; but even if the proof should be regarded as sufficient to show negligence, the deceased was contributorily negligent. The appellant maintains that both issues should have been submitted to the jury.
