Plaintiff, Lewis J. Lieberthal, a resident and citizen of the city of Ironwood, Gogebic county, Michigan, on the 5th day of June, 1944, while in the city of Waukesha, Wisconsin, claims he was very severely injured in an automobile collision that occurred through the negligence of the .Yellow-White Cab Company, a common carrier in whose cab he was riding. The' cab company carried motor vehicle liability insurance in the Glens Falls Indemnity Company of Glens Falls, New York, which also engages in and carries on its automobile insurance business in the States of Wisconsin and Michigan.
