This action was brought by twelve named plaintiffs representing themselves and a class of current and former black and female employees of Owens-Illinois’ Oakland glass container plant. They alleged that the company’s employment and promotion practices violated Title VII, 42 U.S.C. § 2000e et seq., and 42 U.S.C. § 1981 and Executive Orders 11246 and 11375. In addition to their individual claims, appellants asserted classwide claims of discrimination by race or sex in hiring, initial job assignments, transfers and promotions.
