Dennis Martin, an infant, by his father and next friend, Crit Martin, instituted this action in the Floyd circuit court on the 9th day of July, 1934, against the Chesapeake and Ohio Bailway Company for damages in the sum of $3,100, which he alleges resulted to him on account of the defendant, its agents and servants, in. charge of the operation of its train, negligently and carelessly handling same, while he was standing upon and near to the edge of the platform at the flag station of Jump, Floyd county, Ky., with knowledge that he was standing…
