This suit was instituted by defendant in error Couch' against plaintiff in error on a $1,500 fire insurance policy which it had issued to him on his house. He alleged that the house had been totally destroyed by fire. John Armstrong intervened, alleging that he had a mortgage lien on the property and that the insurance policy was payable to him as his interest might appear. The cause was submitted to a jury on one special issue, and on the answer thereto, and additional findings by the court, judgment was rendered for defendants in error for the face of the policy, apportioning the recovery…
