Pending before the Court are Defendant Dick Corporation’s Motion to Alter or Amend the Judgment [67] and Plaintiff Fund’s Opposition to Defendant’s Motion to Alter or Amend the Judgment [69].

I. Background

This case involves Plaintiffs’ claim that Defendant Dick Corporation breached a Collective Bargaining Agreement (“CBA”) that was in effect at its Florida job sites by employing non-union subcontractors. 1 (Mem.
