OPINION AND ORDER

HOLSCHUH, District Judge.

Plaintiff, New Market Acquisitions, Limited (“New Market”), filed suit to recover damages for breach of a commercial lease. In a Memorandum & Order dated March 29, 2001, the Court found that Defendants were liable for damages arising from the breach of the lease and for Plaintiffs attorney fees. The parties then waived their right to a jury trial concerning the scope of damages recoverable under the terms of the lease and the guaranty, agreeing instead to submit factual stipulations and trial briefs.
