OPINION
MUIR, District Judge.
Lloyd Kenneth Covert, Jr. brought this action pursuant to 42 U.S.C. § 1983 and 28 U.S.C. § 1331 seeking declaratory relief, reinstatement to his job, compensatory and punitive damages, and attorney’s fees and costs based upon the Defendants’ alleged violation of his constitutional rights under the due process clause of the Fourteenth Amendment of the United States Constitution.
