These applications, progeny of the consummation of an historic shotgun union, are made to this Court in its enduring capacity as the so-called “rate-court” under Section IX of the Amended Consent Judgement (“Consent Decree”) entered in United States v. ASCAP, 1950-51 Trade Cases (CCH) ¶ 62,595 (S.D.N.Y.1950). The Consent Decree, originally entered in 1941 and subsequently amended in 1950, settled the United States’ antitrust suit against the American Society of Composers, Authors and Publishers (“ASCAP”).
