_JjThe petitioner, Diana Dalier Janet (“Diana” or “the appellant”), filed suit seeking to annul the probated copy of the “Last Will and Testament” of her father, John C. Dalier (“the decedent”), on the basis that the decedent had destroyed the original testament with the intent of revoking it. The trial court held that the copy of the will presented for probate was valid and that the original was presumptively destroyed in Hurricane Katrina with no intention of revocation by the decedent.
