Merrill Lynch, Pierce, Fenner & Smith, Inc., 1 (hereinafter Merrill Lynch), a nationwide stock brokerage firm, filed its complaint in this court on Monday, September 15, 1980, seeking a preliminary and permanent injunction against defendants and former Merrill Lynch account executives Reese M. Stidham, III, H. Paige Scarborough, and John A.
