The questions for decision in this case have been brought to this court by two appeals — one by G. W. Howard and one by D. D. Robertson, receiver of the Citizens’ Bank of Pulaski, Tennessee.

By intervening petition and cross-bill in the chancery court of Giles county, G. W. Howard sought to recover from D. D. Robertson, receiver of the Citizens’ Bank of Pulaski, certain 4% per cent Fourth Liberty Loan United States bonds, of the par value of $1,050, deposited by said Howard in the Citizens’ Bank, or, in the alternative, to obtain a decree for preferential payment of the value of said bonds out…
